A. GENERAL RULES
1. Validity of these general conditions, applicable law and jurisdiction
The person who registers for one or more races organised by the Lugano Bike Emotions Association (hereinafter only ‘LBE’) accepts these general conditions. The Italian language version shall prevail in the event of any inconsistencies with versions translated into other languages.
These provisions shall also apply in the event of the registration of other persons or additional persons (third parties). These third parties are presumed to have authorised the person making the entry. If underage runners are registered by third parties, it is assumed that the consent of the legal representatives has been obtained.
The contractual relationship between LBE and the registered persons is governed by substantive Swiss law (with the exclusion of conflict-of-law rules) and the ordinary courts of Lugano have exclusive jurisdiction in the event of legal disputes.

3. Cancellation or modification of the event
The organiser reserves the right to cancel, reschedule or change the event, in whole or in part, either as a result of indications or recommendations issued by the competent authorities (Confederation and/or Council of State of Canton Ticino), or as a result of its own assessments and decisions in the event of a proven emergency, danger, epidemic or pandemic situation. In the event of cancellation or change of date of the event as a result of such reasons, no claims for compensation shall be considered.
B. REGISTRATIONS
4. Entry fees
The entry fees are those indicated for the various competitions at www.luganobe.ch.
5. Entry deadlines
Registration is possible from the dates indicated on the www.luganobe.ch website and will be completed by the deadline.
In the event that a maximum number of participants is not reached, it will be possible to register at a later date, which may result in a surcharge and no benefits being granted.
6. Registration and payment
On-line via www.luganobe.ch following the instructions given. Payment by credit card. No refund will be granted by LBE in the event of withdrawal from the race.
The organiser reserves the right to disqualify participants at any time and without refund of the amount paid if they have provided false information on personal data at the time of registration.
The organiser reserves the right, at its sole discretion, to refuse or revoke the registration of any participant who, at past or present events, has behaved in a manner deemed not in accordance with the principles of fairness, sportsmanship, or which has been judged to be detrimental to the image of the event, the welfare of the other participants, the public or the organisation's staff. This decision may be taken at any time and without any obligation to provide specific reasons.
The organiser may set a limit on the number of participants. If this occurs, registrations received later cannot be taken into account. Registrations will be registered after receipt of payment.
Registrations made twice will not be refunded, but will entitle the participant to a free start valid for the following year.
The start number may be transferred to another person upon payment of a fee of CHF 10.00. It is not possible to change the type of race for which registration was made. Changes are only possible up to the date of the printing of the bibs and will only be made on presentation of a registration or payment confirmation.
If, as a result of the provisions of point 3 above, or for other reasons of force majeure or as a result of directives from public authorities, the event does not take place on the scheduled date, the person who has registered and paid the relevant fee has only the right to participate, without further costs, in the next competition, in the same type of race. There will be no refund of the fee paid.
7. Bib collection
Bibs are to be collected in the manner and at the locations indicated by the organiser on the website.
C. SAFETY
8. Safety and health of participants and spectators
Neither a medical certificate nor federation membership is required to take part in LBE; however, by registering, each participant self-certifies ‘that he/she is sufficiently trained to take part in this race, that he/she is in good physical health and that he/she has medical confirmation of his/her good health’.
In the event of emergencies and/or regulations by the Swiss public authorities (e.g. in the case of COVID-19 regulations), the organiser may at any time (i.e. even after registration has taken place) require as a prerequisite for participation in the event that the participant possesses and produces certificates and/or other applicable documentation (e.g. a vaccination certificate, ‘covid pass’ and the like).
Very strenuous activity may have negative effects in the case of underlying cardiovascular diseases. It is recommended that the participant undergo a thorough medical examination (with an exercise ECG) before embarking on any LBE competition and more generally before prolonged physical exertion. The organiser recommends that competitors over 40 years of age and/or who have suffered from heart or lung problems, or who belong to a risk group, undergo regular medical check-ups.
If the participant has suffered from an illness or fever in the three months preceding the race, he or she must withdraw from participation.
The organiser recommends adequate drinking before, during and after the competition. If, during the competition, the participant suffers an injury, pronounced fatigue, dizziness, severe pain, etc., he must immediately discontinue the competition and drop out.
The LBE race management and the medical and health personnel present may oblige a participant in an obvious state of breathlessness to stop the race immediately. If the race is continued despite such recommendations and indications, this is done at the responsibility of the participant, without any claim for services (including medical) on the part of the organiser, who accepts no liability in the event of health problems.
We do not recommend the use of earphones during the races, in order to be able to hear any communications from security on the course. The race management may, at any time, interrupt the race if this creates problems for the safety of the participants.
The organiser accepts no liability towards spectators and third parties.
9. Safety concept
The organiser is responsible for setting up a security concept and coordinating all necessary security forces (police, civil defence, medical personnel, etc.).
The instructions of the security personnel (especially the local police) are to be observed and prevail in the event of conflicts with different instructions from third parties.
10. Insurance
It is the responsibility of the participants, should they wish to make use of it.
The organisation declines all liability in the event of accident, damage or theft.
D. DATA PROTECTION
11. Data protection
The use of personal data is governed by the data protection declaration on https://www.luganobe.ch/privacy-policy, to which you can refer for further information and which is an integral part of these general conditions.
The runner undertakes to make personal data of third parties available to the organiser only if they or their legal representatives are familiar with the applicable data protection declaration and only if they are authorised to do so in accordance with the applicable data protection law.
Photos and films taken in the course of our event may be used free of charge on TV, on the Internet, in our advertising material, in our magazines and books.
E. COMPETITION RULES
12. Competition
The instructions and orders of the competition management, safety personnel and the organiser must be strictly adhered to.
The time is measured by means of a chip, which the participant must attach to the bike in accordance with the organiser's instructions. The start numbers are to be made clearly visible at the front.
Private companions with vehicles of any kind are not permitted. A general traffic ban applies to the entire race track. Dogs, buggies, etc. are not permitted. Course cuts as well as any kind of unauthorised aids are prohibited.
13. Doping
The current Swiss doping statute of Swiss Sport Integrity applies to this competition.
Doping controls may be carried out (even without prior warning).
14. Timekeeping
Timekeeping is carried out using microchips.
15. Classifications
The rankings can be consulted online on the site of the timing service immediately after the finish or later on www.luganobe.ch.
Any complaints must be made within half an hour of the display of the rankings by e-mail to: iscrizioni@luganobe.ch.
16. Prizes
Prizes not collected during the prize-giving ceremony on the day of the event by the person entitled (or a person designated by him/her in writing) shall remain the property of the organiser and shall not be sent to his/her home address.
